Dr. Goldentyer,

I am contacting you regarding a matter of the utmost urgency and importance. I have recently obtained photographs from inside the laboratory at Capralogics Inc, PO Box 356, Hardwick, MA 01037. These photographs raise serious doubts as to adherence to Animal Welfare Act regulations by the staff of this facility. I will provide these photos to your office via email. This letter is an Official Complaint against this facility and I am requesting that you initiate an investigation immediately.

Specifically, I believe that these photos reveal violations of the Animal Welfare Act Sec. 2.33 2 (b) 1, 2, & 5 with regard to adequate veterinary care. The rabbits used at this facility appear to be in situations which require veterinary care.

Additionally, the procedures depicted in the photos from Capralogics appear to violate the Animal Welfare Act Sec. 2.31 (D) i & ii which involve the use of animals in potentially painful experimentation. The rabbits in the pictures from Capralogics appear to be fully conscious and confined in restraint devices. These devices would not be necessary if the rabbits were not capable of feeling pain.

The staff of this laboratory clearly has a total disregard for the pain and suffering which are inflicted on the animals in their care. The rabbits used at this facility clearly need veterinary care and/or anesthesia. Also, this facility (from the Capralogics website) produces antibodies for use by other facilities. It is well known that antibodies can be produced in vitro, without the use of animals. Therefore, the work performed at this facility clearly violates the provisions in the Animal Welfare Act regarding alternatives to the use of animals.

Additionally, upon viewing the Capralogics USDA report form for the 2005 reporting period, it is clear that this facility has lied to the regarding the painful nature of the experimentation it is performing. Therefore, this lab may also have violated the provisions of Sec 2.36 of the Animal Welfare Act.

After examining the animals and procedures at this facility I am confident that your regulatory staff will find substantial AWA violations. I request that you immediately implement proceedings to prosecute Capralogics to the fullest extend that the law allows.

I would also request that you provide me with the results of this investigation when it is completed.

Sincerely,

Michael A. Budkie, A.H.T.,
Executive Director, SAEN
